  • Website Development
  • Mobile App Development
  • Branding & Design

All services are provided according to the specific agreement made between the Client and Techily Fly, including scope, timeline, and payment terms.

User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Client Responsibilities

As a Client, you agree to:

  • Provide accurate and complete information required for service delivery
  • Respond promptly to requests for information or feedback
  • Ensure all provided content (images, text, videos) is legally owned or properly licensed
  • Make timely payments as agreed in the service contract
  • Review deliverables within the specified timeframe
  • Provide feedback and approval for work progress

Payment Terms

Payment terms are as follows:

  • A minimum advance payment of 50% is required to commence work
  • Remaining payment is due upon project completion or as specified in the agreement
  • All payments are non-refundable once work has commenced
  • Late payments may result in project delays
  • Additional costs may apply for scope changes or additional revisions

Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of Techily Fly and its licensors. The Service is protected by copyright, trademark, and other laws.

Upon full payment, Clients receive rights to the final deliverables as specified in their service agreement, subject to the terms outlined therein.

Confidentiality

Both Techily Fly and the Client agree to maintain confidentiality regarding:

  • Business strategies and plans
  • Technical information and processes
  • Customer data and lists
  • Financial information
  • Any information marked as confidential

This confidentiality obligation extends beyond the termination of any service agreement.

Project Timeline and Deliverables

Project timelines are estimates based on the scope of work. Techily Fly will:

  • Provide regular progress updates
  • Deliver work according to agreed milestones
  • Notify Clients of any potential delays
  • Allow reasonable time for Client review and feedback

Timeline extensions may be required due to scope changes, delayed feedback, or technical complexities.

Revisions and Changes

Revisions are included as follows:

  • Up to 3 rounds of minor revisions are included in the base price
  • Major revisions or scope changes may incur additional costs
  • All revision requests must be submitted in writing
  • Revision requests must be received within 14 days of deliverable

Cancellation and Termination

Either party may terminate the service agreement with written notice:

  • Client cancellations before work commencement: 80% refund of advance payment
  • Client cancellations after work commencement: No refund for work completed
  • Termination by Techily Fly: Due to non-payment or breach of terms
  • Completed work will be delivered upon payment for services rendered

Prohibited Uses

You may not use our Service for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction. You agree not to:

  • Use the Service for any fraudulent or unlawful purpose
  • Violate any international, federal, provincial, or state regulations
  • Infringe upon or violate our intellectual property rights
  • Harass, abuse, insult, harm, defame, or discriminate
  • Submit false or misleading information
  • Upload viruses or other malicious code
  • Spam or send unsolicited communications

Limitation of Liability

In no event shall Techily Fly, our directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

Our total liability to you for any cause of action shall not exceed the amount paid by you for the services.

Indemnification

You agree to defend, indemnify, and hold us harmless from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including attorney's fees).

Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

All disputes shall be resolved through mutual discussion. If no resolution is reached, disputes may be settled through arbitration in accordance with Indian law.

Force Majeure

Techily Fly shall not be liable for any failure to perform its obligations where such failure is as a result of acts of nature, war, terrorism, riots, government actions, or other events beyond our reasonable control.

Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms.

Entire Agreement

These Terms, together with any service agreements, constitute the entire agreement between you and Techily Fly regarding the use of the Service and supersede all prior and contemporaneous written or oral agreements between you and Techily Fly.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

Your continued use of the Service after the effective date of the revised Terms constitutes acceptance of the changes.
